Terms of Service

These Terms of Use ("Terms") govern access to and use of the Evalis platform owned by Evalis Inc., including all content, services, tools, interfaces, and generated reports (collectively, the "Platform"). By accessing the Platform or ordering a report, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Purpose of the Platform
Evalis provides condominium assessment reports for informational purposes only, based on documents supplied by the client. Reports present a risk score computed using a proprietary model with 50 criteria. They are not legal opinions, technical diagnostics, or investment advice, and do not replace an accredited inspector or consultation with a notary, lawyer, real-estate broker, or other qualified professional. Service is limited to condominiums located in Québec and does not apply to newly built properties (under one year), single-family homes, or commercial buildings.
2. Neutrality and independence
Evalis is independent and not affiliated with any real-estate broker, developer, builder, notary, building inspector, or condo association.
3. User responsibilities
Users are responsible for collecting and submitting required documents, obtaining necessary permissions, ensuring accuracy and completeness, interpreting and using results, and making any purchase/negotiation/withdrawal decisions based on the report.
4. Liability limitations
Evalis and its officers, employees, suppliers, subcontractors, and partners are not liable for any damages, direct or indirect, including decisions made based on the report; errors, omissions, or inaccuracies in user-provided documents; consequences of missing/low-quality documents; issues arising after the report date (latent defects, special assessments, incidents, etc.); financial loss, loss of opportunity, loss of enjoyment, or other material/non-material damages. No guarantee of results, profitability, or perceived objectivity is given. Evalis's total liability is limited to the amount paid for the specific report.
5. Report validity
Each report reflects the condominium's status at the time of analysis and based on available documents. Subsequent changes (meetings, incidents, lawsuits, defects, emergency work, etc.) may alter the situation.
6. Turnaround and delivery
Subject to receipt of all required documents after payment:
Standard service: report delivered within a maximum of 3 days.
Express service: report delivered within a maximum of 24 hours.
No report will be produced until all required documents have been received. Deadlines may exceptionally be extended due to circumstances beyond the reasonable control of Evalis.
7. Refunds
No refunds, except if Evalis fails to meet the selected delivery timeframe. No refunds for ordering errors, dissatisfaction, incomplete documents, or withdrawal after payment. No post-payment document additions; scores cannot be retroactively changed.
8. Intellectual property
All content, tools, reports, models, and interfaces are the exclusive property of Evalis. Reproduction, modification, distribution, or reuse is prohibited without prior written authorization.
9. Data and privacy
Documents and personal data are handled confidentially. Evalis does not sell or share your data with third parties without explicit consent, except where required by law.
9.1 Use of Google Data (Sign in with Google)
Evalis offers the option to sign in or create an account using the "Sign in with Google" feature (Google Sign-In). This section describes in a transparent manner the data that Evalis accesses in this context, the purposes for which it is used, the conditions under which it is stored, and the circumstances in which it may be shared.
9.1.1 Data accessed. When you choose to sign in with your Google account, Evalis accesses only the following data, strictly necessary for authentication and user account creation:
▪ Your email address associated with your Google account
▪ Your first and last name, if available in your Google profile
▪ A unique identifier associated with your Google account (technical authentication identifier)
Evalis does not at any time access your emails (Gmail), your storage (Google Drive), your contacts, your calendar (Google Calendar), your photos, or any other content, service, or data from your Google account that is not directly related to authentication.
9.1.2 Purposes of use. The data obtained through Google is used exclusively for the following purposes:
▪ Creating your user account on the Evalis platform
▪ Enabling secure and simplified sign-in to your account
▪ Reliably identifying you within the application
▪ Managing your access to the platform's features
This data is never used for advertising, behavioral profiling, commercial targeting, or any other secondary purpose not described in these Terms.
9.1.3 Storage and processing. The data obtained from your Google account is stored securely as part of the normal operation of the Evalis service, in accordance with the security measures described in the Privacy Policy section. It is processed with the same level of protection as all other personal data of the platform's users.
9.1.4 Data sharing. The data obtained through Google is not sold, rented, or shared with third parties for commercial, advertising, or marketing purposes. It may only be disclosed to a third party in the following cases:
▪ Where required by law, regulation, or court order
▪ Where strictly necessary for the hosting, maintenance, or secure operation of the service (technical service providers acting on behalf of Evalis, subject to confidentiality obligations)
9.1.5 User control. You retain control over your data at all times. In particular, you may:
▪ Delete your Evalis account, which will result in the deletion of associated data
▪ Revoke the access granted to Evalis from your Google account security settings (https://myaccount.google.com/permissions)
9.1.6 Compliance commitment. The data obtained through Google services is used solely for the purposes described in these Terms and is never used for any other purpose. Evalis is committed to limiting access to Google data to the strict minimum necessary for sign-in and user account creation.
10. Confidentiality and dissemination restrictions
10.1 Strict confidentiality. Evalis reports (PDFs, excerpts, screenshots, charts, scores, and derivative content) are strictly confidential. They are licensed for personal, limited, non-exclusive, non-transferable use by the purchasing client.
10.2 Authorized recipients. Sharing is permitted only with: (a) the listing broker (seller) and their agency; (b) the broker representing the Buyer. Any other sharing (seller, association, co-owners, inspectors, notaries, lenders, insurers, appraisers, media, public/private platforms, etc.) is prohibited without Evalis's prior written authorization.
10.3 Specific prohibitions. Prohibited actions include: re-publishing, indexing, posting on public sites, social networks, MLS portals/intranets; modifying, excerpting, removing legal notices/watermarks; creating derivative works or commercial/marketing materials based on the report.
10.4 Security and retention. The client must store the report securely (no open public links), restrict access to authorized recipients only, and remove shared links at the end of the transaction.
10.5 Monitoring and remedies. Evalis may use identifiers/watermarks and access logs. In case of breach, Evalis may revoke the license, suspend/close the account, and pursue available remedies.

11. Changes
Evalis may update these Terms at any time; changes take effect upon publication.
12. Governing law
These Terms are governed by the laws of Québec; disputes fall under the competent courts of the judicial district of Montréal.
